By accessing or using Nain Music, you agree to comply with these Terms & Conditions. If you do not agree with these terms, please do not use the website or services.

1. About Nain Music

Nain Music is a music-focused platform and creative service provider offering music-related services and opportunities.

Depending on the services and features available at a particular time, Nain Music may provide or facilitate services such as:

• Music composition

• Music production

• Songwriting and lyrics writing

• Vocal arrangement

• Mixing and mastering

• Full music production

• Music-related education and live classes

• Other music-related services introduced on the platform

Nain Music may expand, modify, suspend, or discontinue particular services or features from time to time.

2. Use of the Website

You agree to use the Nain Music website and services only for lawful purposes.

You must not:

• Use the website for fraudulent, misleading, or unlawful activities

• Attempt to gain unauthorized access to the website or another user's account

• Upload or submit malicious software, spam, or harmful material

• Misuse another person's identity or information

• Violate copyright, trademark, privacy, or other intellectual property rights

4. Customer Orders and Services

When a customer places an order for a Nain Music service, the customer agrees to provide the information, files, instructions, references, and other materials reasonably necessary to complete the requested service.

The exact scope, deliverables, price, duration, revisions, and other conditions may vary depending on the selected service or provider.

Customers should clearly communicate their requirements before or during an order.

Additional work outside the agreed scope may require a separate agreement or additional payment.

5. Service Providers and Future Marketplace

Nain Music may operate a marketplace model in which independent musicians, engineers, producers, teachers, artists, or other music professionals can offer services or classes to customers.

Where such a marketplace is available, providers are independent participants and are not automatically employees of Nain Music merely because they offer services through the platform.

Providers may have freedom to determine their available services, topics, pricing, duration, working methods, and availability, subject to Nain Music's platform rules and approval requirements.

Nain Music may review or approve providers before allowing them to offer services publicly.

Approval does not constitute a guarantee of a provider's future earnings, customer demand, or success.

6. Marketplace Payment and Platform Share

Where the Nain Music marketplace uses a platform payment and settlement system, the customer may pay through the payment method made available by Nain Music.

Unless a different arrangement is clearly stated for a particular service, the intended standard marketplace revenue model is:

80% to the service provider and 20% to Nain Music.

The applicable platform share may be calculated from the eligible service amount after any applicable taxes, payment charges, refunds, adjustments, or other deductions where required.

Settlement to a provider may occur after the relevant service or class has been completed and the applicable settlement conditions have been satisfied.

The exact payment and settlement process may depend on the payment service provider and the technical functionality available on the platform.

7. Live Classes

Nain Music may offer live, one-to-one or other live music-related classes through approved teachers or professionals.

A student may select a particular topic or learning requirement rather than being required to follow a fixed course level.

The teacher may determine the teaching method, duration, requirements, and structure of the class, subject to the agreed service description.

Classes may be conducted through Zoom or another live communication platform specified for the booking.

Students are responsible for having a suitable internet connection, device, and required software or platform access unless otherwise stated.

A student is not entitled to a refund solely because they did not personally like the teaching style or found the class unsuitable after participating in it.

Refunds may be considered where the teacher cancels, fails to provide the agreed class, or where another reasonable circumstance justifies a refund under the applicable Refund & Cancellation Policy.

8. Provider Responsibilities

Providers offering services through Nain Music are responsible for:

• Delivering the agreed service professionally and within the agreed scope

• Providing accurate information about their skills and experience

• Respecting customer rights and communications

• Using lawful and original material or properly licensed material

• Respecting copyright and intellectual property rights

• Maintaining appropriate communication with customers

• Informing Nain Music of circumstances that prevent them from completing an accepted order

Providers must not make false claims about qualifications, experience, results, or ownership of creative work.

9. Customer Responsibilities

Customers are responsible for:

• Providing accurate project information

• Providing necessary files and instructions

• Respecting agreed service scope

• Communicating reasonable requirements

• Respecting the intellectual property rights of providers and third parties

• Not submitting material that they do not have permission to use

Customers must not use Nain Music to request unlawful, infringing, fraudulent, or abusive work.

10. Copyright and Intellectual Property

Users remain responsible for ensuring that the material they upload, submit, or provide to Nain Music does not infringe the rights of another person.

This may include lyrics, melodies, recordings, samples, images, videos, artwork, project files, or other creative material.

Unless otherwise agreed in writing, Nain Music does not automatically acquire ownership of a customer's original creative material merely because it is submitted for a service.

Ownership and usage rights relating to a completed project may depend on the agreement applicable to that particular service.

Nain Music may take appropriate action regarding content that is reasonably believed to infringe copyright or other intellectual property rights.

11. Music Uploads and Community Features

If Nain Music provides community features allowing musicians to create profiles, upload music, gain followers, receive comments, or share work, users remain responsible for the content they publish.

Users must have the necessary rights or permissions to upload and publicly share their content.

Nain Music may remove content or restrict accounts where there is a reasonable concern involving copyright infringement, fraud, spam, abuse, unlawful activity, or violation of platform rules.

12. Reviews, Feedback, and Comments

Users may be permitted to provide reviews, ratings, comments, or feedback regarding services or providers.

Reviews and feedback should be genuine and based on the user's actual experience.

Users must not submit fake reviews, manipulate ratings, threaten providers for favorable reviews, or use reviews to harass another person.

Nain Music may remove content that violates these Terms or applicable law.

13. Revisions and Changes to Services

Where a service includes revisions, revisions will normally be limited to the scope of the original order.

A request that substantially changes the original requirements may be treated as additional work.

Nain Music or the relevant provider may clarify the scope before continuing with additional work.

14. Cancellations, Refunds, and Disputes

Orders and bookings may be cancelled or refunded according to the applicable Refund & Cancellation Policy.

Where a dispute occurs between a customer and provider, Nain Music may review the relevant order details, communications, submitted files, service description, and other available information to help resolve the matter.

Nain Music may take reasonable action based on the circumstances of the dispute.

Customers and providers should first attempt to communicate clearly and resolve ordinary misunderstandings before escalating a dispute.

Fraudulent refund claims, payment manipulation, chargeback abuse, or deliberate misuse of the dispute system are prohibited.

15. Third-Party Platforms

Some Nain Music services may depend on third-party platforms or technologies, including payment providers, video-conferencing services, hosting services, communication tools, or other external services.

Nain Music does not control the availability, security, policies, or technical operation of third-party platforms.

Users may be required to accept the applicable terms and privacy policies of those third parties.

16. Availability of the Platform

Nain Music aims to keep the website and services available and functional but does not guarantee uninterrupted or error-free operation.

The website or individual features may occasionally be unavailable because of maintenance, technical problems, updates, third-party service failures, or circumstances beyond Nain Music's reasonable control.

Nain Music may modify, suspend, or discontinue features when reasonably necessary.

17. No Guarantee of Results

Nain Music does not guarantee that a particular music service, class, production, promotion, release, or collaboration will produce a specific commercial, artistic, educational, audience, streaming, or financial result.

Results may depend on many factors outside the control of Nain Music or an individual provider.

18. Limitation of Liability

To the extent permitted by applicable law, Nain Music will not be responsible for indirect, incidental, special, or consequential losses arising from the use of the website or services.

Nain Music's responsibility in relation to a particular service may be limited to the extent permitted by applicable law and the specific terms agreed for that service.

Nothing in these Terms is intended to exclude any liability that cannot lawfully be excluded.

19. Suspension or Termination

Nain Music may suspend or terminate access to an account, service, or platform feature where there is a reasonable basis to believe that a user has violated these Terms, engaged in fraud or abuse, infringed intellectual property rights, or created a risk to the platform or other users.

Where appropriate, Nain Music may provide an opportunity to resolve an issue before taking further action.

Nain Music may update these Terms & Conditions as the platform, services, technology, or applicable requirements change.
